Former cop’s petition disposed of by Meghalaya High Court

Shillong, Oct 12: The Meghalaya High Court has disposed of a petition filed by a former cop who was alleged of raping two minor sisters in 2013, with a direction to pass appropriate order with regards to his representations within four weeks.

In its judgment passed on Friday, Chief Justice Mohammad Yaqoob Mir said, “…this petition is taken up for final disposal at its threshold stage, as such is disposed of with a direction to make it known to the petitioner as to what has happened to the two representations, in case considered or otherwise, any disciplinary proceeding has been conducted and any order thereon has been passed, copies of the same shall be furnished to the petitioner.”

Nurul Islam, a former second in-charge of Ampati Police Station, had filed a petition seeking the intervention of the Court to issue direction for allowing him to join his duty and to release all the arrears of pay with effect from March 2013 along with interest at the rate of 12% per annum.

He also urged the Court to direct the authorities concerned to dispose of his representations submitted on December 20, 2015 and August 18, 2017.

Islam was sacked from service after he was alleged of raping a 14-year-old girl inside the Ampati police station on March 13, 2013 and raping her elder sister on March 31, 2013 in their house at gun point.

It may be mentioned that he was taken into custody on June 1, 2013. On the following day, he escaped from police custody at Tura, the district headquarters of West Garo Hills.

As against him on June 1, 2013, an FIR was lodged registered as Ampati Police Station Case No. 34 (6) of 2013 under Section 376 (2) (1) (a) of the Indian Penal Code.

However, Islam in his petition said that after registration of the case in 2013, he does not know whether any Disciplinary Proceedings have been initiated against him or thereafter any action has been taken against him.

Islam informed that he had submitted a representation to the SP of South West Garo Hills District on December 20, 2016 where he had mentioned that he is facing a regular trial, he wants to know the status of his service.

He has requested for supply of the following documents – Suspension order, Charge against him, Inquiry report, if any, Evidence, if any, Findings of the authority, Order of promotion to the post of UB-SI and any other documents with the further request that he be reinstated.

The petitioner further claimed to have submitted another representation to the SP on August 18, last year wherein, he has requested the authority to allow him to join his duty and to release all his dues whatever due.

In his petition, Islam informed that he was appointed in the Meghalaya Police in the year 1983, and was promoted to the rank of Sub-Inspector in 2004, and has distinguished service records and was instrumental in apprehending various militants and terrorists organisations.

He also claimed to have played a pivotal role in dismantling various terrorist camps, outfits and controlling the extortion and other illegal activities.
